IT-08-36: Economic Stimulus Payments

This Transmittal announces that on February 22, 2008, Dear Colleague Letter (DCL)-08-06, Economic Stimulus Package, was issued by the Federal OCSEOffice of Child Support Enforcement, regarding the signing of Public Law No. 110-185, the Economic Stimulus Act. This was followed on March 17, 2008, by DCL-08-09, entitled IRS Economic Stimulus Payments. They each announced that the Department of Treasury will begin sending economic stimulus payments to over 130 million recipients beginning in early May. Treasury has confirmed the following information, after meetings with FMSFederal Management Services, on how injured spouse claims will be handled on joint returns, during the stimulus payment process.

IT-09-78: USDA Farm Service Payments

This transmittal announces the Administration for Children and Families’ DCL-09-24, dated August 14, 2009. Beginning on or around September 1, 2009, all FSAFarm Service Agency/CCCCommodity Credit Corporation payments will be processed through Treasury’s FMSFederal Management Services and therefore eligible for Federal administrative offset. Since the FSA/CCC payments are considered to be administrative vendor payments, up to 100 percent of each payment can be intercepted.

IT-10-01: Administrative Offset Program

This Transmittal provides information on the Federal Administrative Offset Program for which New Jersey has been submitting cases since the implementation of NJKiDS. Administrative Offset allows for the interception of certain federal payments in order to collect past-due child support.

IT-10-04: eFlash 09-14

We have received notification from the DFASDefense Finance and Accounting Service that Denver’s Freedom of Information and Privacy Act services for Air Force military records, has moved to DFAS Indianapolis. Several changes have been made in the mailing addresses used to handle payroll records.

IT10-05: eFlash for 09-17

The OCSE released FCR e-Flash 09-17 to announce that the DFAS has assumed payroll responsibilities for employees of the Department of VAVeterans Affairs. Child support agencies should no longer send income withholding orders against VA employees to VA offices. (Note: This change does not affect sending income withholding orders against VA beneficiaries, who are disabled veterans. Income withholding orders against VA beneficiaries will continue to be processed through the Regional VA office that provides the benefits to the NCPNon-custodial parent.)

IT-10-27: Procedures for Submitting the Request for New Entry, Modification of OTHP

This IT and it’s attachments have been revised from the original IT #08-109, dated December 10, 2008, to correct the incorrect email address for the submission of OTHPOther Party Information requests to the NJKiDS Help Desk and to provide updated contact information.

IT-11-17: Distribution of Federally Approved National Medical Support Notice

On March 29, 2011, the federal Office of Child Support Enforcement distributed an updated NMSNNational Medical Support Notice. Enforcement of medical support orders is mandatory and the NMSN is used to contact the employer and the health care provider. IT-11-32: Turner v. Rogers United States Supreme Court Decision

Attached is the United States Supreme Court decision in Turner v. Rogers, which was issued on June 20, 2011. Please note that the Court determined that the due process clause of the 14th Amendment does not automatically require an indigent defendant be provided legal counsel at a civil contempt hearing. Nonetheless, the Court established that the State must provide “alternative procedural safeguards” to provide a fair determination of the supporting parent’s ability to comply with the support order, including:

  1. Notice to the defendant that the “ability to pay” is a critical issue in the contempt proceeding;
  2. The use of a form (or the equivalent) to elicit relevant financial information;
  3. An opportunity at the hearing for defendant to respond to statements and questions about his or her financial status, (e.g., those triggered by the response on the form); and
  4. An express finding by the court that the defendant has the ability to pay.

IT-12-57: Project Save Our Children (PSOC) with PSOC Forms

This transmittal provides clarification of the PSOCProject Save Our Children program in New Jersey to assist local entities in determining whether a case is suitable for PSOC submittal. The forms are are included in the body of this document.

IT-18-02: Jackpot Intercept Program (update to IT 16-18)

This transmittal informs staff that the threshold to check for child support arrears for jackpot winnings has been lowered. Please review this IT in its entirety.

IT-18-06: Bureau of Fiscal Service Offset Notice

The transmittal indicates that the U.S. Department of Treasury’s BFSBureau of the Fiscal Service has updated their Offset Notice.  The notice contains FTIFederal Tax Information and appropriate safeguards must be taken any time this notice is received from a child support client. AT-18-02: Medical Support and NMSN Processing Updates (See Federal AT 11-03)

The final rule, effective January 26, 2001, implemented provisions of the Child Support Performance and Incentive Act of 1998, Public Law 105-200. These provisions require State CSChild Support agencies, under title IV-D of the Social Security Act, to enforce the health care coverage provision in a child support order and to use the NMSN to aid enforcement. Tribal IV-D agencies are not required to use these forms.

AT-16-05: SOP: Bankruptcy

Attached is AT 16-05 entitled Standard Operating Procedure: Bankruptcy (supersedes AT 15-20). This transmittal is to make staff aware that effective March 21, 2016, updates will be made to the New Jersey Kids Deserve Support (NJKiDS) system that will affect how bankruptcy filings are processed.
