Standardized Forms

The federal regulations require the use of standardized forms in intergovernmental cases, including the following:

Child Support Enforcement Transmittal #1—Initial Request form

The Child Support Enforcement Transmittal #1—Initial Request form serves as a cover letter to refer child support enforcement intergovernmental cases to any responding agency’s ICRInterstate Central Registry. It contains basic case information and the specific services requested by the initiating agency, such as establishment of paternity and/or support obligation, modification, or enforcement.

Child Support Enforcement Transmittal #1—Acknowledgment

After receiving Child Support Enforcement Transmittal #1—Initial Request, the responding agency completes the Acknowledgment to indicate what office the case was forwarded to and to request any additional information or forms that are needed to take further action on the case.

Child Support Enforcement Transmittal #2—Subsequent Actions form

The Child Support Enforcement Transmittal #2—Subsequent Actions form is used by either the initiating or the responding jurisdiction to request or provide additional information or services in previously-referred IV-D intergovernmental cases. The transmittal should be sent to the local entity working the case, rather than the other state’s ICR, unless the local entity working the case is unknown. The transmittal is used to provide the following types of action:

  • Status update
  • Notice of hearing
  • Notice of case forwarding
  • Document filed
  • Order issued
  • Arrears calculation (month by month)
  • Payment history
  • Arrears balance and/or accrued interest (affidavit of arrears)
  • Notice of health care coverage change
  • Notice of case receiving tax refund offset from federal collection and enforcement program
  • Nondisclosure finding/affidavit
  • Other — if “Other” is selected, the information being requested or provided must be documented

The transmittal is used to request the following types of action:

  • Status update
  • Arrears balance and/or accrued interest (affidavit of arrears
  • Payment history
  • Arrears calculation (month by month)
  • Administrative review for contested debt certification in the federal collection and enforcement program
  • Other (List and describe in section III)

Uniform Support Petition

The Uniform Support Petition is used to initiate the action in the responding tribunal.  Acts as the legal pleading to assert that the tribunal has jurisdiction, to show enough facts to notify the respondent of the claim being made, and to provide the petitioner with a means to request specific action or relief.

General Testimony

The General Testimony provides a framework for stating the detailed information and evidence necessary to support the action requested in the petition. The information and documentation are used in lieu of live testimony from the CPCustodial parent or party and the initiating agency. The document must contain all the information necessary to obtain a court order, and the signature of the CP and the agency representative must be notarized. The document contains 11 sections and may or may not apply to every case. See Table below. Before the General Testimony is completed, several case characteristics must be considered to determine what information should be provided, for example, the status of the individual petitioner completing the testimony and his/her relationship to the respondent, and the relief staff plans to request in the petition.

Declaration in Support of Establishing Parentage

The Affidavit in Support of Establishing Paternity summarizes the evidence to establish parentage.

Letter of Transmittal Requesting Registration

The Letter of Transmittal Requesting Registration Statement is used when requesting registration of an existing order for enforcement or modification in a responding jurisdiction.  Requires specific order information and must be included with the order in a request for registration. A separate statement must be sent for each order for which registration is requested.

Child Support Enforcement Transmittal #3—Request for Assistance/Discovery form

The Child Support Enforcement Transmittal #3—Request for Assistance/Discovery form is used when IV-D agency needs limited assistance and/or payment forwarding only from another IV-D agency without opening an intergovernmental IV-D case.

  • Staff is to use the Transmittal #3 if requesting another state forward payments to New Jersey (formerly known as redirection) when the other state has an open IV-D case, payments are being received and no request for enforcement, modification or registration is being made.  The case is to remain as an “Instate” one-state action without the need to open an Interstate Information page.

Child Support Locate Request

The Child Support Locate Request  is used to request locate only services from another child support agency for information on either parent.

Child Support Enforcement Transmittal #3 — Request for Assistance/Discovery Acknowledgment

After receiving a Child Support Enforcement Transmittal #3 — Request for Assistance/Discovery form, the receiving state completes the acknowledgment section. The acknowledgment can be used to provide information in response to the request, indicate that additional information is necessary, and state to whom the request was forwarded to.

Types of Action Requested

The types of action requested with the Child Support Enforcement Transmittal #3 – Request for Assistance/Discovery document include the following:

  • Copy of: Support Orders (must be certified)
  • Copy of: Payment record(s) (must be certified)
  • Assistance with Service of Process
  • Assistance with genetic testing
  • Assistance with teleconference for hearing or deposition
  • Assistance with administrative review
  • Assistance with discovery
  • Assistance with AEI

The requesting agency may ask for the following limited service(s), which may be provided at state option:

  • Assistance with a lien
  • Financial data/proof of respondent's income
  • Other

The requesting agency asks for the following payment processing action:

  • Forward payments received by your agency's SDU to the requesting agency's SDU for disbursement.
