Continuation Request Process Overview

Overview

A party to the case may request that support be continued past age 19 if the child is still in high school, is a full-time postsecondary school student, or is disabled. The party should complete and mail the Request for Continuation of Support Form, which is included with the CS735 and CS736 notices. The deadline to submit request forms is 45 days before the proposed termination date. The Termination activity chain will automatically open once the CPCustodial parent or party sends in the form and it is received and scanned by the NJFSSCNew Jersey Family Support Services Center. Child support staff will receive an Action Alert to view the scanned documents in the Termination activity chain.

In some cases, notices may be received by a local office instead of NJFSSC. In this event, the documents should be scanned and uploaded to NJKiDS and Probation should manually open the Termination chain. For more information and guidance, please refer to Action Transmittal 17-05.

Deadline Exceptions

When the CP has submitted documents in a timely manner, but the request is denied for failure to provide appropriate documents, the CP may provide the necessary documents after the 45-day deadline has passed.

If demographic or system updates were made that now make the case eligible for termination (e.g. controlling order changed to New Jersey, DOBDate of birth update, or AHIS update), notices may go out with a 45-day review deadline that has already passed. Probation must reach out to the CP to determine if a continuation request will be submitted.  If so, they must give the CP an opportunity to provide the appropriate documentation even though the deadline has passed.

Continuation Requests Returned Centrally to the NJFSSC

The CS735 and CS736 contain instructions to return requests for continuation to the NJFSSC.

  • Incoming documents are opened and sorted by type (NJKiDS or External).
    • An external document is a document that does not contain an original NJKiDS 2D barcode. Examples include the following items:
    • Anything returned without the continuation of support form (additional proofs)
    • Copy of a continuation request form
    • NJKiDS documents (CS735 and CS736) will be scanned along with any supporting documentation.
  • The system will read the 2D barcode on the NJKiDS document and take an appropriate action based on the document received and the status of the case/member:
    • Is the document being returned from the custodial parent (CP) or the noncustodial parent (NCP)?
    • Is the case open?
    • Has child support for the dependent already been terminated?
    • Is there already an open Termination activity chain for the case/dependent combination?

Remember that the NCP may fill out the request form for submitting a prior court order.

Note: Nothing prevents Probation staff from reaching out to a customer to request missing information after sending the Determination of Request for Continuation of Support (CS738).

External Documents related to termination will be scanned, classified, and indexed. An Action Note to File will be sent to the assigned Probation Case Worker Role, RP035, containing the document images. The worker must review the images on the View/Update Notes page and take appropriate action. The worker must resolve the note to delete the alert.  

Note: The Termination chain will not open when an external document is scanned.  

Agency Responsibilities

CP Sends in Request Form

  • Staff will receive the Worker Review action alert.
  • When double-clicked, NJKiDS will navigate to CPRO, Termination activity chain to view the scanned documents.
  • Alert will be deleted when the worker advances the chain to the next step:
    • Record Supervisor Approval to Retain Existing Termination Date
    • Record Supervisor Approval to Modify Termination Date

NCP Sends in Request Form

  • Staff will receive an Action Note to File: “CS735/CS736 received from NCP has been scanned and requires review.”
  • When double-clicked, NJKiDS will navigate to the NOTE screen to view the scanned documents.
  • Staff must resolve the note to remove the alert.

CP/NCP Sends in Continuation Requests Document without Barcoded Request Form

  • Documents will be scanned manually into NJKiDS as external documents and staff will receive an Action Note to File: “ECM Action Note to File.”
  • When double-clicked, NJKiDS will navigate to the NOTE screen to view the scanned documents.
  • Staff must resolve the note to remove the alert.
  • The Termination activity chain must be manually initiated by the worker.

CP/NCP Sends in Request Form for a Dependent with a Terminated Obligation, an Open Termination Activity Chain, or a Closed Case

  • Staff will receive an Action Note to File: “CS735/CS736 received scanned and processed requires review.”
  • The action note will navigate to the NOTE screen to view the scanned images.
  • Staff must do the following:
    • Review the documents and case conditions
    • Follow up with the parties accordingly

Filtering Termination Alerts

  • When the CS735/736 is scanned into the system, the case owner will receive a Worker Review action alert.
  • The Worker Review alerts for termination are time-sensitive, so they should be filtered as indicated below:
    • Category: CM—Case Management
    • Sub Category: Term—Termination
  • Click the Find button.

Acceptable Reasons and Proof

Attach a copy of the court order

Child is still enrolled in high school

Attach letter from school on letterhead confirming full-time enrollment status

Child is still enrolled in a post-secondary education program full-time

 

Attach one of the following:

  • A copy of official current full-time enrollment certificate

  • A letter from school on letterhead confirming full-time enrollment status

Child has a physical or mental disability, as determined by a federal or state government agency, that existed before the child reached age 19

Attach one of the following:

  • Federal or state eligibility determination letter

  • Proof of federal or state benefits received due to the child’s disability

  • Court-ordered determination of the child’s disability

Note: For high school verification, CPs do not have to prove full-time status. Proof of enrollment is enough. SSASocial Security Administration is not the only government agency that makes disability determinations.

Request for Continuation of Support Form–CP Instructions

If the CP is requesting continuation due to education, he or she must enter the projected graduation date. The date must not exceed the child’s 23rd birthday. If CP provides two different dates (projected graduation date and termination date fields) on the request form, the worker should go with the later date as the new termination date as long as it does not exceed the 23rd birthday.

If the CP is requesting continuation of support due to disability, he or she must enter the new termination date. The date must not exceed the child’s 23rd birthday.

Note: Either party may file a motion or application for the continuation of child support and Title IV-D services beyond the child’s 23rd birthday if the child suffers from a severe physical or mental incapacity.

Staff may reach out to request more information or proof in addition to sending the Determination of Request for Continuation of Support (CS738). Proofs may or may not contain a future date. Disregard any dates contained on the proof. Only go with the date on the continuation request form. Accept the date CP provides regardless of which field was used.

Please note that the proofs should not be provided to the NCP. The order and notice to the parties contains the reason for continuation.

Request for Continuation Received Without Proper Documentation

The CP may file a motion if he or she feels that the obligation should continue. The filing of the motion does not stop the termination process from proceeding.
